1. Why this matters
Insurance is not a substitute for good engineering, but it is a backstop when something goes wrong. Our baseline program is designed to cover the most common claim scenarios our clients face, and to satisfy the "additional insured" and certificate requirements of enterprise procurement.
2. Coverage we maintain
| Line of coverage | What it covers | Form |
|---|---|---|
| Commercial General Liability (CGL) | Bodily injury, property damage, and personal & advertising injury arising from our operations. | Occurrence-based, with contractual-liability coverage. |
| Professional Liability / Errors & Omissions (E&O) | Negligent acts, errors, or omissions in the professional services we deliver (consulting, code, configurations). | Claims-made, with extended reporting period (ERP) on termination. |
| Cyber Liability | First-party (forensic, notification, credit monitoring, business interruption) and third-party (defense, damages, regulatory fines where insurable) arising from a cyber event on our systems or on systems we manage for clients. | Claims-made; covers data breach, network failure, social engineering, and funds-transfer fraud (where sub-limited). |
| Workers' Compensation | Statutory benefits for our employees for work-related injuries, as required by California and other states of operation. | Statutory. |
| Commercial Auto Liability | Owned, hired, and non-owned auto for company business (rare, but maintained). | Combined single limit. |
| Umbrella / Excess Liability | Excess limits over CGL, Auto, and Employer's Liability. | Follow-form. |
We do not generally maintain Tech E&O or Media Liability as separate lines; cyber liability and professional liability together cover the relevant exposures. Where a client SoW requires a specific line (for example, Crime / Fidelity, or Media Liability for a publishing engagement), we add it or accept a certificate of insurance from a sub-contractor.
3. Limits and retentions
| Coverage | Each occurrence / claim | Aggregate | Retention (deductible) |
|---|---|---|---|
| Commercial General Liability | US$1,000,000 | US$2,000,000 | US$2,500 |
| Professional Liability (E&O) | US$2,000,000 | US$3,000,000 | US$10,000 |
| Cyber Liability | US$2,000,000 | US$4,000,000 | US$25,000 (higher for funds-transfer sub-limit) |
| Workers' Compensation | Statutory | Statutory | - |
| Commercial Auto | US$1,000,000 CSL | - | US$1,000 |
| Umbrella | US$5,000,000 | US$5,000,000 | - |
Sovereign-tier engagements routinely require higher limits. We can increase Professional Liability and Cyber Liability to US$5M-US$10M per claim for an additional premium, which is passed through at cost.
4. Carriers
We procure coverage from carriers rated A or better by AM Best, with admitted status in the states where we operate. Specific carrier names are provided in the certificate of insurance.
5. How to request a certificate
To request a Certificate of Insurance (COI) naming your organization as an additional insured or certificate holder, email legal@empowered.guru with:
- Your legal entity name and address.
- The engagement name or SoW number.
- Whether you need additional-insured status, waiver of subrogation, primary-and-noncontributory wording, or other specific endorsements.
- The state or country where the engagement will be performed.
We turn COIs around within 5 business days. We do not provide copies of full policies; we provide a summary of coverage and the COI.
6. How to give notice of a claim
To give notice of a claim or a circumstance that may give rise to a claim, email claims@empowered.guru with: (a) a description of the incident, (b) the date and location, (c) the names of any people involved, (d) any demand, lawsuit, or regulator notice received, and (e) the engagement name. Do not include confidential or personal data in the notice; we will follow up under our NDA and DPA.
7. Changes
We review our coverage annually. The current version of this notice reflects the coverage in force at the effective date. Material changes (carrier, coverage line, or a reduction in limits) are communicated to active clients with a SoW.
